Terms of Service

These terms govern the use of the mobile application Artex (the “app”), published by Simon Bernard (Self-employed / Micro-entrepreneur). By installing and using the app, you accept these terms.
1. Purpose
The app lets you photograph the wall label of a work on display, read its details on your device, and keep the work in a personal library that doubles as a visit journal. It is licensed, not sold.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, in accordance with the App Store and Google Play Store rules.
3. In-app purchase (“Support”)
The app offers a one-time purchase, named “Support”, unlocking additional features: the visit journal and its map, custom tags, the accent themes, and the alternate app icon.
- Reading labels, the library and the number of works it holds, enrichment, search, favorites, and the PDF export remain free and uncapped, whether or not you buy Support.
- Payment is processed by Apple’s App Store or the Google Play Store; those platforms’ terms apply.
- The purchase is final and tied to your Apple or Google account. You can restore it free of charge on your other devices through the same store.
- Refunds are subject to Apple’s and Google’s policies; they are not handled by the publisher.
4. Photographs taken on exhibition premises
You are solely responsible for the photographs you take and for their compliance with:
- the rules of the venue you are visiting (some museums prohibit photography, the use of flash, or photography in certain rooms or of loaned works);
- copyright: works still under protection may only be photographed and kept for strictly private use, to the exclusion of any public distribution.
The publisher exercises no control over this content and has no access to it.
5. Automatic label reading
Reading a label and extracting its fields is performed automatically and may contain errors or omissions, notably depending on lighting, typography, or the angle of the shot. The information displayed is indicative and must be verified before any documentary, educational, or published use. It remains editable at any time in the app.
6. Third-party content and attribution
When online enrichment is enabled, the app displays information from Wikidata, Wikipedia, and Wikimedia Commons. That content remains the property of its authors and is distributed under its own licenses, notably CC BY-SA; the corresponding attribution notices are shown in the app and carried over into PDF exports. You must keep them in case of reuse.
The publisher is not responsible for the accuracy, completeness, or availability of this third-party content.
7. Your data
Because the app runs offline, you are solely responsible for your data and its backup. See the Privacy Policy.
8. No warranty
The app is provided “as is” and “as available”, without warranty of any kind, express or implied. We do not warrant that it will be error-free or uninterrupted, nor the accuracy of information read, entered, or displayed.
9. Limitation of liability
To the extent permitted by law, the publisher shall not be liable for any direct or indirect damages, including any loss of data, arising from the use of or inability to use the app.
10. Intellectual property
The app, its content, brand, logo, and design are the property of the publisher and are protected by intellectual property law. Photographed works and third-party content remain the property of their respective authors or rights holders.
11. Changes
We may modify these terms and the app at any time. Continued use after an update constitutes acceptance.
12. Governing law
These terms are governed by French law. Any dispute shall fall under the competent courts, subject to the protective legal provisions applicable to consumers.
